Official Rules

The Barone Fini “Take the Taste Challenge and Win a Trip to Italy” Sweepstakes (the “Sweepstakes”) begins approximately at 12:00 AM Eastern Standard Time (“EST”) on 01/12/11 and ends at 11:59:59 PM EST on 03/31/11 (the “Promotion Period”).

ELIGIBILITY: The Sweepstakes is open to legal US residents 21 years of age or older, excluding all residents of AK, CA, and HI. Employees of W.J. Deutsch & Sons, Ltd., (“Sponsor”), Sponsor’s advertising/promotional agencies, Drink Twits LLC, and their respective affiliates, alcohol beverage licensees, and any person connected with this Sweepstakes (plus immediate family members of all such employees and all others with whom they are domiciled) are not eligible to participate in the Sweepstakes. The term “immediate family members” includes spouses, grandparents, siblings, children and grandchildren.

HOW TO ENTER: (1) visit www.winetwits.com/tastechallenge and complete the online entry form. Provide your full name, address (no post office boxes accepted), city, state, zip code, telephone number, email address and date of birth. Incomplete entries will be invalid and not accepted. There is a limit of one entry per person or household. The use of automated entry devices of any kind is prohibited.

DRAWING AND PRIZE: A random drawing will be conducted on or about 04/07/11 to select one (1) Grand Prize Winner (“Winner”), subject to confirmation of eligibility, from among all eligible entries received during the Promotion Period. The Grand Prize (“Prize”) will consist of i) round-trip coach air transportation for the Winner and Winner’s Guest (“Guest”) from the major international airport closest to Winner’s residence to Venice, Italy, (specific date to be confirmed), ii) hotel accommodations for Winner and Guest for three (3) nights (1 room/double occupancy), and iii) a $400 gift card which may be used toward meals/beverages/etc. The Approximate Retail Value (ARV) of the Prize is $3,500, but may vary based on the location of the originating airport. The odds of winning will depend on the total number of eligible entries received. Winner and his/her guest must have valid passports and all other required documentation (that do not expire within 6 months of time of travel) prior to time of departure and are responsible for obtaining all such travel documents. Travel arrangements must be made through Sponsor’s agent, on a carrier of Sponsor’s choice, and following an itinerary of Sponsor’s choice. Any and all other additional costs and expenses not specifically mentioned herein including, but not limited to, transportation to/from airports, taxis, insurance, passport/travel documents, gratuities, taxes, meals, beverages, and personal expenses, are the Winner’s responsibility to pay.

PRIZE CONDITIONS: Travel must be completed by June 30, 2011. The Winner and Guest must each be 21 years of age or older and be eligible for entry into Europe or the Prize will be forfeited. If Sponsor is unable to contact Winner after three (3) days from date of the first notification attempt, or if Winner (i) fails to complete and return all requested documents by the specified date, (ii) is found to be ineligible, (iii) fails to comply with the Official Rules, or, (iv) cannot complete travel by June 30, 2011, his/her Prize will be forfeited and Sponsor will select an alternate winner. If Prize confirmation letter is returned as undeliverable, Prize will be forfeited. Guest has no independent rights to the Prize or any portion thereof. Winner and Guest must travel on the same itinerary (same flights, hotel stay, etc.). All components of the Prize must be used at the same time. In the event the ARV is greater than the actual cost of the Prize, no refund for the difference will be provided. Guest must attend any events provided as a component of the Prize with the Winner. Prize is subject to availability. Winner and Guest will each be required to sign an Affidavit of Eligibility and Liability/Publicity Release, and return same, properly executed, within five (5) days of date of receipt of Prize notification. All federal, state and other taxes are the responsibility of the Winner and Sponsor will report the value of the Prize as required by the IRS. Reservations are required for airfare based on space availability, and must be booked a minimum of three (3) weeks prior to the planned departure date. Blackout periods may apply. In the event that the Winner does not use any portion of the Prize, there will be no extension, transfer, substitution or any kind of compensation provided. The Prize must be accepted as awarded without substitution and is not transferable, not for resale or auction, and has no cash surrender value. The Sponsor reserves the right, in the event that the Prize or any component of the Prize cannot be awarded as described for any reason, to substitute another prize or component of the Prize of equal or greater value. Use of the Prize by Winner and Guest constitutes permission where permitted for Sponsor to use Winner and Guest’s name and photograph in perpetuity for promotional purposes, on a world-wide basis, in all forms of media, and without notice or further compensation. All components of the Prize are to be used solely to attend the specific events awarded as the Prize. Winner and Guest will abide by all Rules set forth by any private or public venue. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity in regard to the mechanics of the Sweepstakes or the interpretation of these Official Rules. Headings are provided for convenience only. Sponsor will not acknowledge invalid entries. Entrants also agree to release, discharge, indemnify and hold harmless the Sponsor and Drink Twits LLC, and their respective affiliates, directors, officers, employees and agents, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind, resulting in whole or in part, directly or indirectly, from acceptance, or use of the Prize, participation in this Sweepstakes, or breaching any agreement contained herein. Any disputes regarding this Sweepstakes shall be governed by New York law and resolved in courts sitting in Westchester County, New York. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorney fees. Entrant waives any claim for punitive, incidental and consequential damages. A purchase will not increase a chance of winning.

LIMITS OF LIABILITY: The Sponsor and its agencies are not responsible for entries that are not received due to technical/transmission difficulties, or for late, lost, incomplete, postage due, or misdirected entries. All entries become the property of the Sponsor. Sweepstakes is subject to all applicable federal, state and local laws. Any person attempting to defraud or in any way tamper with the mechanics of this Sweepstakes will be declared ineligible and may be prosecuted. Sponsor is not responsible or liable for any loss, damage, inconvenience, or loss of time arising out of any acts, omissions, or negligence, of any other person, including, without limitation, air and ground transportation carriers or any person providing any service or accommodation in conjunction with the Prize, or for delays and cancellations including, but not limited to those resulting from mechanical breakdown, closings, strikes, government action, inclement weather, or Acts of God. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by any printing, technical or human error which may occur during the Sweepstakes. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation, theft or destruction or unauthorized access to, or alteration of entries. If the Sweepstakes is not capable of being conducted as planned due to tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right in its sole discretion to terminate the Sweepstakes prior to the end of the Promotion Period, and award the Prize through a random drawing from among all eligible entries received up to the time of termination. VOID WHERE PROHIBITED.
